1. Acceptance of Terms

By accessing or using BhaujAI ("Service", "Platform"), you agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our Service. These Terms constitute a legally binding agreement between you and BhaujAI.

2. Description of Service

BhaujAI is an AI-powered business automation platform that provides:

• Instagram DM Automation: Automated responses to direct messages with smart AI-powered replies
• Comment Management: Automated replies to Instagram comments on your posts
• Content Scheduling: Planning and scheduling Instagram posts and stories
• Lead Collection & CRM: Capturing and managing customer relationships and leads
• Analytics & Reporting: Performance insights, engagement metrics, and conversion tracking
• Multi-channel Integration: LinkedIn, Gmail, WhatsApp and email workflow automation
• AI Chat: Intelligent business assistant powered by AI

3. Eligibility and Account Requirements

• You must be at least 18 years old to use BhaujAI
• You must have the legal authority to operate and connect the Instagram, LinkedIn, Gmail, or other accounts you integrate with our platform
• You must provide accurate and complete information when creating your account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person or entity may not maintain multiple accounts

4. Account Management and Billing

4.1 Account Creation

You must create an account with a valid email address and secure password. You are solely responsible for all activities that occur under your account.

4.2 Subscription Plans

• Free Plan: Limited features with usage restrictions
• Paid Plans: Enhanced features with higher usage limits, billed monthly or annually
• Subscription fees are charged in advance and are non-refundable except as required by law
• Access to paid features will be revoked if payment fails or subscription expires

4.3 Payment Terms

• All fees are exclusive of taxes, which you are responsible for paying
• We may change pricing with 30 days' notice to existing subscribers
• Refunds are provided only in accordance with our refund policy

5. User Content and Data Ownership

5.1 Your Content

You retain full ownership of all content, data, and information you provide to or generate through BhaujAI, including:

• Messages, comments, and posts
• Automation workflows and templates
• Lead and customer data
• Analytics and performance data
• Any other content you create or upload

5.2 License to Us

You grant BhaujAI a limited, non-exclusive, royalty-free license to process, store, and transmit your content solely to provide our services. This license terminates when you delete your content or close your account.

5.3 Data Export

You can export your data at any time through our platform tools. Upon account termination, we will provide a reasonable opportunity to retrieve your data.

6. Acceptable Use Policy

6.1 Prohibited Activities

You agree not to use BhaujAI to:

• Violate any laws, regulations, or third-party rights
• Send spam, unsolicited messages, or engage in harassment
• Create fake accounts or impersonate others
• Distribute malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Use our platform for illegal activities or fraud
• Scrape or harvest data from our platform without permission

6.2 Platform-Specific Restrictions

Regarding Instagram and other connected platforms, you must not:

• Violate Meta's Platform Terms, Instagram Terms of Use, or Community Guidelines
• Use Instagram data for purposes outside of legitimate business operations
• Share or sell Instagram data obtained through our platform
• Engage in artificial engagement (fake likes, comments, follows)
• Send automated messages that violate platform policies
• Use our service to circumvent platform rate limits or restrictions

6.3 Enforcement

Violation of this Acceptable Use Policy may result in:

• Warning or account suspension
• Immediate account termination
• Removal of violating content
• Legal action where appropriate
• Reporting to relevant authorities or platforms

7. Third-Party Platform Dependencies

7.1 Meta Platform Integration

BhaujAI integrates with Meta's platforms through official APIs. By connecting your accounts, you authorize us to access and process your data in accordance with Meta's Platform Terms, our Privacy Policy, and these Terms of Service.

7.2 Service Limitations

Changes to third-party APIs, policies, or availability may affect or interrupt our services. We are not liable for disruptions caused by third-party platforms and will make reasonable efforts to adapt to such changes.

8. Intellectual Property Rights

BhaujAI and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use BhaujAI for your business purposes in accordance with these Terms.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using BhaujAI, you consent to our data practices as described in the Privacy Policy.

10. Service Availability and Modifications

We strive to maintain high service availability but do not guarantee uninterrupted access. We may modify, update, or discontinue features at any time with reasonable notice for significant changes.

11. Account Suspension and Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activities, fail to pay subscription fees, or use our service in a way that harms our platform or other users.

12. Disclaimers and Warranties

BHAUJAI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHAUJAI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY DAMAGES EXCEEDING THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes will be resolved through good faith negotiations, binding arbitration, or courts of competent jurisdiction in India.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website, sending email notification, or displaying a notice in your dashboard. Your continued use of BhaujAI after changes become effective constitutes acceptance of the updated Terms.
